The main issues regarding the development of the site related primarily to part of the site being located within Flood Zone 3, and the higher level ground which is considered to be more exposed within the south eastern part of the site. Consequently we reviewed these issues and appointed technical consultants to assess these matters in detail. We then coordinated the project team to take these important matters into account by proposing that the higher levels of ground accommodate a community orchard, and the lower levels of ground which are more prone to flooding, for lower risk uses such as sports pitches and allotments.
We secured a draft allocation for the site in early 2016 but unfortunately North Somerset Council members were not prepared to support or determine the application. In light of a lack of five year housing land supply in the council area we have pursued an appeal for non-determination towards the end of 2016. In order to maximise our client's chances of obtaining a useable planning consent we are also submitted a revised parallel application.
No5 Chambers represented us during the Inquiry process alongside a number of other competent experts in matters of five year housing land supply, landscape impact, and affordable housing. Within his decision, the Inspector agreed with our stance that landscape impact would be localised only and the proposed development would not be unduly apparent in the landscape; that the council’s shortfall in housing land supply is ‘significant and serious’ and consequently the application must be determined within the context of paragraph 14 of the NPPF, and that overall, whilst there is a minor adverse impact on the setting of the landscape, this would not be outweighed by the social and economic benefits of the scheme. The Inspector granted the appeal permission in April 2017.
